Why this pack exists — the compliance backdrop

Since November 2023, National Trading Standards guidance has set out the material information expected on every listing (Parts A, B and C). Since 6 April 2025 the duty sits in the Digital Markets, Competition and Consumers Act 2024: omitting material information is a misleading omission, and the CMA can fine directly — up to 10% of turnover. The exposure is real; the fix is process, not panic.

How to use this pack

  • Read pages 2–3 as the data half. Every green row is evidenced, with its public-register source and as-of date.
  • Hand page 4 to the vendor. The amber rows become 17 numbered questions — written answers complete the listing file.
  • Check the date stamps. Registers move — re-run the pack if the listing goes live 8+ weeks after the data vintage.

Locked in the title — or answered by a register 5 ASK THE VENDOR · 2 FROM DATA · 2 NOT APPLICABLE

Restrictive covenants ➤ Ask the vendor Only the title register answers definitively — ask what the vendor knows now (question 1). Title check available: HM Land Registry official copy (~£3), or register flags via licensed data — ask Streetwise. Title register · Q1
Easements / rights of way ➤ Ask the vendor Shared drives, drains and paths rarely show outside the title and the vendor's knowledge (question 2). Title check available — official copy (~£3) or register flags; ask Streetwise. Title register · Q2

Why the amber rows are the point

A listing that quietly omits these points is what the misleading-omissions rules catch. A file showing the question was asked and answered in writing is the strongest position an agent can hold.

The Vendor Questionnaire
49 Westminster Road · CH2 3AR · SAMPLE
The other half of the truth
The Vendor Questionnaire
Seventeen plain-English questions covering every amber row. Send them as-is; written answers complete the listing file.

A · Title & tenure

1
Are there any covenants restricting alterations, extensions or business use — or anything else on the title?
2
Any easements or rights of way — shared access, drains, paths or driveways?
3
Ground rent and service charge — n/a here (freehold); template row kept for leasehold listings.
4
Have you received any notices affecting the property — planning, enforcement or party wall?

B · Utilities & services

5
Any private water supply — is the water metered? Who supplies electricity; smart or prepay meters; any EV charging?
6
Is drainage to the mains, or a septic tank / treatment plant? If off-mains: where, when last emptied, 2020 rules met?
7
When was the gas boiler last serviced — is there a record?
8
Is there a current electrical certificate (EICR)? Any known issues?
9
EPC (Feb 2026): 107 m² with 2 recorded extensions. Do the extensions have building-regs sign-off and completion certificates?

C · Building & safety

10
Any non-standard construction — timber frame, concrete panels, flat roofs, spray-foam loft insulation?
11
Any structural movement, underpinning, or claims for subsidence, damp or flooding?
12
What year was it built — and what work has been done since, with certificates or guarantees?

D · Environment

13
Has the property flooded in the last 5 years — or ever? Any defences or insurance conditions?
14
Are you aware of any mining activity or mining reports? (Belt-and-braces — Coal Authority data places it outside the coal reporting area.)
15
Any Japanese knotweed on the property, or within 3 metres of the boundary?

E · Accessibility & parking

16
What adaptations are there — step-free access, rails, wet room — and are any being removed?
17
Parking, yard or rear access: owned outright? Any permit scheme, restrictions or shared arrangements?

Important notices

Not a compliance certificate. A data-sourced summary plus a vendor question set. Whether a listing meets the material-information duty depends on the full listing content and the answers received. Full methodology: usestreetwise.com/methodology.

Not legal advice. Consult a qualified professional on specific transactions; title points must be verified by a conveyancer against official copies.

Sample pack — representative data. Produced to demonstrate the format. Values are a representative mix of live public-register data (EPC, location, flood status and council-tax charges are real for this address) and illustrative sample figures (e.g. the council-tax band, tenure and asking price). For a live instruction, every green row is verified against the cited register before the listing relies on it. Not to be relied on for an actual transaction.
